Participant or Legal Guardian of an Event Participant
("I", "me","my").
The City of Hamilton & Hamilton Region Conservation Authority in which this
event occurs, Online Registrations, the Race Director and
all members thereof; any and all sponsors and affiliated
or contributing associations; all participants and
officials; their respective agents, representatives,
employees, successors and assigns ("you").
IN CONSIDERATION of acceptance of my entry, I the
undersigned, for myself, my heirs and executors,
administrators assigns and personal representatives,
DO HEREBY REMISE, RELEASE AND FOREVER DISCHARGE,
WAIVE AND SAVE HARMLESS, PROTECT AND KEEP you INDEMNIFIED
FROM AND AGAINST ANY AND ALL manner of actions,
causes of action, proceedings, suits, claims, demands,
costs and expenses in respect of injury, death,
loss and/or damage to my person or property of whatever
kind of nature, HOWSOEVER CAUSED, which may
be suffered or incurred, directly or indirectly,
for, upon, by reason of or arising out of, my participation
prior to, during or subsequent to, this event AND
NOTWITHSTANDING that the same may have been contributed
to or occasioned to, in whole or in part, the negligence
of any of the aforesaid. I ATTEST AND VERIFY
that I am fully aware of the physical risk of
injury of death involved in participating in this
event and VOLUNTARILY AGREE to accept full responsibility
and legal liability for same, that I am physically
fit and have trained sufficiently for this event.
I am aware that the weather conditions on the day
this event is scheduled to take place can be unpredictable.
It could be quite warm or quite cold, either condition
posing and increasing physical risk. BY SUBMITTING
this waiver and the required entry fee for the event,
in any form, I ACKNOWLEDGE HAVING READ, UNDERSTOOD
AND AGREED to the above WAIVER, RELEASE AND INDEMNIFICATION
and ATTESTATION.
I ATTEST AND VERIFY THAT I AM 18
YEARS OF AGE OR THAT I AM SIGNING AS THE LEGAL GUARDIAN
ON BEHALF OF AN EVENT PARTICIPANT UNDER THE AGE
OF 18 YEARS.
Agreeing to this waiver and registering
online for this event by me, for myself or as legal
guardian of an event participant, in an electronic
format authorizes you to accept this waiver as signed
by me.
